What Is Harta Gono-Gini?

Harta gono-gini refers to property acquired by a husband and wife during the marriage. The term comes from Javanese tradition, but Indonesian law recognizes it as harta bersama — joint marital property, the equivalent of community property. Examples include a house, a car, savings, or investments bought during the marriage. Property brought in before the marriage (harta bawaan) and any inheritance or gift declared to be personal property are not included in this category.

  1. Article 35 paragraph (1) of Law No. 1 of 1974 on Marriage — property acquired during the marriage automatically becomes joint property, unless there is a prenuptial agreement.
  2. Article 119 of the KUHPerdata (the Indonesian Civil Code) — confirms that joint property applies from the moment of marriage, unless the parties agree otherwise in an agreement.
  3. The KHI (Kompilasi Hukum Islam, the Compilation of Islamic Law) — Article 85 of the KHI recognizes joint property, but the division is handled proportionally (usually 50:50).

Types of Property in a Marriage

  1. Pre-marital property (harta bawaan) — owned before the marriage (for example, an inherited house).
  2. Separate property — a gift or inheritance declared to be one spouse’s personal property.
  3. Joint property (harta gono-gini) — acquired during the marriage (for example, salary, or a jointly run business).

How Harta Gono-Gini Is Divided

On Divorce

  • Deliberation (musyawarah) — a fair settlement reached by agreement, without going to court, is preferred.
  • Court — if agreement fails, the judge divides the property 50:50, though the split can differ based on financial or non-financial contribution (for example, child-rearing).
  • Debt — divided by agreement or by court decision, especially if it was used for the family’s needs.

On Death

Joint property becomes part of the estate. The heirs (children, spouse) are entitled to their shares under the inheritance law that applies — the Civil Code (KUHPerdata) or the KHI.
