Small-Claims Suits & E-Court: Collecting Debts up to Rp500 Million in Purbalingga

You run a shop or a small business in Purbalingga. The goods were delivered or the work was finished, but the invoice is still unpaid. The amount may not be large, and you hesitate to go to court because you picture a slow, expensive process that needs a lawyer. Yet for a debt with a clear value up to Rp500 million, Indonesian law offers a far shorter route: gugatan sederhana (a small-claims suit), which can now be filed and heard online through e-court.

This article explains gugatan sederhana in depth — the conditions, the steps, how to file through e-court at the Pengadilan Negeri (District Court) of Purbalingga, and its limits — so you can judge for yourself whether the route fits your claim. It complements our more general guide on collecting unpaid debts through the courts, which mentions gugatan sederhana only in passing.

What a Gugatan Sederhana Is

A gugatan sederhana (small-claims suit) is a civil procedure built to be fast, simple, and low-cost. Its basis is Perma No. 2 of 2015, as amended by Perma No. 4 of 2019 on the Procedure for Settling Small-Claims Suits (a Perma is a Supreme Court Regulation). The 2019 amendment raised the ceiling from Rp200 million to Rp500 million, bringing far more business debts within reach.

Three features set it apart from an ordinary civil suit:

  • it is examined by a single judge (hakim tunggal), not a panel of three;
  • it must be resolved within 25 working days of the first hearing — a legal maximum, not a guaranteed timeline;
  • the parties need not be represented by an advocate, so a business owner can appear in person.

For a debt that arises from an agreement, the ground is wanprestasi (breach of contract), not perbuatan melawan hukum (an unlawful act, or tort).

Conditions and Limits

A gugatan sederhana cannot be used for every dispute. The main conditions:

  • the case is a wanprestasi (breach of contract) or perbuatan melawan hukum (tort) with a material claim value of no more than Rp500 million;
  • there is no more than one plaintiff and one defendant, unless they share the same legal interest;
  • both parties reside within the jurisdiction of the same District Court;
  • the defendant’s domicile must be known;
  • the parties attend the hearings in person, and may be assisted by a representative.

Expressly excluded are land-rights disputes and matters that belong to a special court. So if your debt is entangled with a dispute over land ownership, this route is closed. The domicile requirement is also a common obstacle: if the defendant lives outside the jurisdiction of PN Purbalingga, the plaintiff usually has to appoint a representative based in the defendant’s area.

How the Fast Procedure Works

The speed comes from a trimmed sequence:

  1. Filing the suit together with the evidence at the District Court.
  2. Completeness check; the judge assesses whether the case meets the criteria. If not, it is declared not a small-claims suit and the file is returned.
  3. Appointment of the single judge and a substitute registrar.
  4. Preliminary examination, then the hearing date and the summons.
  5. First hearing and an attempt at settlement. If settlement is reached, a binding settlement deed (akta perdamaian) is issued that cannot be contested.
  6. Evidence and judgment — all within 25 working days of the first hearing.

If the defendant fails to appear despite a proper summons, the case may be decided by verstek (default judgment). The plaintiff may also request sita jaminan (a conservatory attachment) so the defendant’s assets are not moved while the case runs.

Filing Through E-Court

Since Perma No. 7 of 2022, amending Perma No. 1 of 2019 on the Electronic Administration and Hearing of Cases, a gugatan sederhana can be filed and heard electronically. PN Purbalingga already offers this service. Through e-court you can:

  • file the suit online (e-filing);
  • receive an automatic cost estimate (e-SKUM) and a virtual account for payment (e-payment);
  • receive the summons electronically (e-summons);
  • attend the hearing electronically (e-litigation).

An individual or business owner who is not an advocate registers as a Pengguna Lain (“Other User”): create an account at ecourt.mahkamahagung.go.id, then visit the e-court desk or PTSP (one-stop service counter) of PN Purbalingga once, with your KTP (national ID card) or passport, for verification. After the account is verified, later filings are done online. One important point from Perma 7/2022: the electronic hearing can proceed even if the defendant does not agree to it.

The Only Remedy, and the Cost

A gugatan sederhana has no appeal (banding), cassation (kasasi), or judicial review (peninjauan kembali). The sole remedy is keberatan (an objection), filed within 7 days of the judgment being pronounced or notified, to the Head of the District Court. The objection is examined by a panel of three judges (majelis hakim) at the same court, and its decision is final and binding.

As for cost, the principle is “low-cost”, but the advance court fee (panjar biaya perkara) varies from court to court and can change. Do not calculate it yourself from figures circulating online — ask the e-court desk or consult first.

Practical Steps in Purbalingga

  1. Confirm the case qualifies: value up to Rp500 million, based on wanprestasi, not a land dispute, with the defendant’s domicile known and within the same jurisdiction.
  2. Gather the evidence: the agreement, invoices, transfer proofs, receipts, and the collection history including any somasi (formal demand letter).
  3. Create an e-court account as a Pengguna Lain, then verify it with your KTP or passport at the e-court desk of PN Purbalingga.
  4. File the suit online; pay the advance via virtual account after receiving the e-SKUM.
  5. Attend the preliminary examination and the first hearing; use the settlement stage to agree on payment or instalments.
  6. If you win but the debt is still unpaid, apply for eksekusi (execution) to the Head of PN Purbalingga.

Conclusion

A gugatan sederhana is the right route for a debt with a clear value up to Rp500 million, arising from an agreement, with a known defendant in the same jurisdiction. It is heard by a single judge, resolved within 25 working days of the first hearing, filed through e-court without hiring an advocate, and subject to only one remedy: keberatan. Its limits are firm — not for land disputes, not for an unknown defendant, and not for a value above Rp500 million.
